Terms & Conditions (Cancellation Policy)
Booking Terms & Conditions:
The following terms apply - "OWNER" shall mean the individual, company or organisation that owns the property. "PORTUGAL PORTFOLIO" shall mean "Nduni Property Portfolio & Management – Mediação Imobiliária Lda t/a Portugal Portfolio". "CUSTOMER" shall mean the individual, company or organisation who made the booking and or the person who is the lead name on the booking form. "GUESTS" shall mean the Customer's party and / or parties named on the reservation form.
The customer warrants that the properties let are to be used for the purposes of a holiday and so accepts that the letting is of a temporary and transitory nature and may not sub-let the premises or any part thereof. The number of people occupying the premises shall not exceed the number stated for the premises in the reservation confirmation. Failure to comply with occupancy numbers will result in immediate cancellation of the booking without refund of any rents paid. In exceptional cases the OWNER (or OWNERS agent) may give permission for extra people to occupy the premises, in this case there may be an additional charge at OWNERS (or OWNERs agents) discretion.
The customer and his/her GUESTS blind and oblige themselves to vacate the rented premises without demand at the termination of the period of the rental. The customer acknowledges that PORTUGAL PORTFOLIO acts as an agent for the property OWNER.
All on-line bookings are provisional until confirmed in writing by PORTUGAL PORTFOLIO. An initial deposit is required to confirm a reservation. Balance of rental amounts are due 2 weeks before arrival or by special arrangement, in cash on arrival. We reserve the right to withhold handing over of keys where payment has not been made in full before or on arrival. Please note that all transfer costs, bank charges, PayPal charges or credit/debit card fees are for the account of the renter. PORTUGAL PORTFOLIO reserves the right to change or amend prices on their website at any time without any prior notice. Bookings will always be honoured at the rate it was booked of regardless of whether the price goes up or down after the booking is made.
A security deposit is required and is held against breakages and/or excessive cleaning costs. The security deposit is fully refundable once the property has been checked after departure. We aim to return your deposit within 3-5 days. Responsibility lies with GUESTS staying at the property to make their own arrangements for travel insurance cover should they injure themselves during their trip and for loss of and/or damage to personal possessions.
Properties offered by PORTUGAL PORTFOLIO are not commercial entities and therefore not easily re-rented. We strongly advise customers to take out our travel insurance to protect against medical emergencies or other unforeseen circumstances that preclude the client from travelling. All cancellations must be written (emails are acceptable) and become effective on the date of receipt by PORTUGAL PORTFOLIO. In the case of cancellation, the charge is equal to the booking deposit. PORTUGAL PORTFOLIO may consider other cancellation terms in exceptional circumstances. These considerations are at the entire discretion of PORTUGAL PORTFOLIO.
In the case that PORTUGAL PORTFOLIO or the OWNER is forced to cancel or amend the booking due to force major or any other occurrence outside of their control, PORTUGAL PORTFOLIO'S liability will be limited to the refund of any amounts paid plus bank or credit/debit card charges. In no circumstance will PORTUGAL PORTFOLIO be responsible for any consequential losses or incidental damages including alternative accommodation or lodgings, travel expenses, loss of enjoyment or any other expenses. PORTUGAL PORTFOLIO will however endeavour to offer the CUSTOMER an alternative property of similar standing. Building work and the resulting noise is not within the control of the owner or PORTUGAL PORTFOLIO, therefore neither will accept any claims whatsoever for compensation or refunds in the case of building works taking place near or around the property you are renting.
Bookings run from 15:00 on day of arrival to 11:00 on day of departure, unless otherwise agreed in writing. During busy times, it may be necessary for the final clean to start earlier than 11:00; however this will always be by prior arrangement. Standard check-in time is between 15h00 and 18h00; different check in times can be arranged upon request, however will attract a supplement: After 18h00 - 15 Euros, after 21h00 - 25 Euros & check-in after 23h00 will attract a supplement of 50 Euros. Alternatively, if full payment for rental is made before arrival, arrangements can be made for key collection and self-check-in without additional cost. A representative of PORTUGAL PORTFOLIO will still be available for telephone assistance where required.
Early check-in can be facilitated where there is no previous GUEST leaving on the same day. Please ask us if you require an earlier check in. Please note that, for security reasons, the lead person for this reservation must bring a copy of their ID card or passport when you check-in, alternatively, these can be scanned and emailed to firstname.lastname@example.org before your arrival.
If a fixed time is arranged to meet guests at the property and there is a no show within 30 minutes of the arranged time, a waiting charge of €25 will be made against the booking deposit.
The Customer or the person signing the check-in form will be liable for the correct and decent behaviour of all the persons accompanying him/her, and specifically avoiding any activity that is against any law or health policy. Please don't forget that you are going to stay in residential buildings. GUESTS staying in one of our properties should know that if parties or loud music are heard, or neighbours complain and/or police are called, it can result in immediate eviction. This will also result in loss of prepaid rent. Quiet time in Portugal is from 10 pm to 10 am. When leaving, please leave the apartment in a clean condition. Smoking is not permitted in the property unless otherwise stated.
Some of the properties listed on our website are 100% managed by PORTUGAL PORTFOLIO and some are carefully handpicked by us for inclusions in our website but remain under the management of their OWNERS. Although all OWNERs are required by agreement with PORTUGAL PORTFOLIO to carefully maintain and keep their properties in the high standard expected by our GUESTS, PORTUGAL PORTFOLIO cannot be held responsible for any misrepresentation by OWNERS. In all cases we do periodic checks and follow-ups in order to help OWNERS to maintain the high standard of quality our GUESTS demand. We welcome all comments about our properties in order to maintain the high standards you expect. PORTUGAL PORTFOLIO makes every effort to ensure the advertised descriptions are correct, however, we do not own any of the accommodation and therefore cannot control or prevent changes. Should we become aware of major changes we will inform you as soon as possible. No compensation will be payable by PORTUGAL PORTFOLIO or the owner as a result of these changes. No claims will be accepted for costs or additional expenses incurred by GUESTS as a result of such change. Claims for accident, loss, damage, injury, inconvenience or any other claim are acknowledged to be solely between the customer and the OWNER. PORTUGAL PORTFOLIO does not accept liability for any loss or damage caused by weather conditions, safety issues, riot, strikes, sickness or any other cause beyond its control.
It is the GUEST'S responsibility to take all keys, remote controls and other supplied equipment for access to their holiday home when they are out. If GUESTS lock themselves out of the property at night due to a lack of key sets or remote controls, neither the owner nor PORTUGAL PORTFOLIO will be responsible for any costs incurred by GUESTS. If PORTUGAL PORTFOLIO is called out to supply an additional key set a supplementary call out charge will be applied to the booking.
PORTUGAL PORTFOLIO and the CUSTOMER agree that this contract shall be governed by Portuguese law. The exclusive jurisdiction over all disputes arising out of this agreement shall be in the courts located in Portugal.
